Fierce Healthcare: Blue Cross Plan Accused Of Fraud In 'Ghost Network' Class-Action Lawsuit
October 23, 2024
In “Blue Cross Plan Accused Of Fraud In ‘Ghost Network’ Class-Action Lawsuit” (Fierce Healthcare, October 23, 2024), Fierce Healthcare discusses the class action lawsuit filed by Pollock Cohen LLP partner Steve Cohen and co-counsel Walden Macht Haran & Williams LLP partner Jake Gardener against Anthem Blue Cross Blue Shield regarding the issue of inaccurate health care provider directories and their impact on patients’ access to mental health care.
The article explains that patients have faced significant challenges when trying to find in-network health providers due to “ghost networks,” which are either non-existent, unavailable or not covered by Anthem BCBS. The plaintiffs’ attorneys completed a secret shopper survey to see how extensive the problem is for patients. After calling the first 100 doctors on Anthem’s directory, only seven accepted insurance and could take new patients. A news release explains that most would not accept the right insurance, were not mental health providers, refused to take new patients, or simply could not be contacted. This practice violates multiple laws, including the No Surprises Act and the Mental Health Parity and Addiction Equity Act.
