In "Using the New York FCA to Combat Offshore Tax Evasion" (Law360, Expert Analysis, April 14, 2015), Adam Pollock introduces the New York's Fraud, Enforcement & Recovery Act, which is the "first-in-the-nation state program to allow tax fraud recoveries under a false claims act." It was legislated to target illegal off-shore tax shelters and hold those who committed tax evasion accountable. Under this law, "an individual with knowledge of offshore tax evasion can assist New York in recovering lost tax revenues by bringing an action as a whistleblower and, if such an action is successful, may share in up to 30 percent of the state's recovery."
