In "Judge Keeps FCA Case Against Kaiser Permanente Alive" (Law360, February 14, 2024), Law360 discusses a U.S. District Court Judge's decision to dismiss certain portions of a suit brought by a former Kaiser Permanente employee. The former employee claims that Kaiser schemed to defraud the federal government out of millions by inflating its Medicare capitation rates.
The California federal Judge, however, also allowed key parts of the False Claims Act suit to continue, giving the compliance-officer-turned-whistleblower three weeks to file an amended complaint.
