In "Justices Won't Review Dismissed Reddit Child Porn Suit”, (Law360, May 30, 2023) the US Supreme Court has declined to review a dismissed sex-trafficking lawsuit against Reddit, reinforcing the lower court's ruling that the website is immune under Section 230 of the Communications Decency Act.
According to the court, the plaintiffs failed to prove Reddit's involvement or profit from the sex-trafficking venture. The court emphasized that Reddit can only be held responsible for its own criminal conduct, not user-generated content.
The Ninth Circuit panel acknowledged the limitations of the FOSTA amendment in holding websites accountable for trafficking and stated that Congress should address these issues. The dismissed suit involved explicit content posted by an ex-boyfriend on Reddit, which the platform allegedly failed to address adequately. The Supreme Court's decision maintains Section 230 immunity for Reddit.
