In "NYC Council ‘Lukewarm’ on Mayor Adams’ Push to Change City Law as Part of Medicare Advantage Battle: Sources" (New York Daily News, October 12, 2022), Mayor Adams' attempt to change the law in order to change the healthcare plan provided to its retirees to Medicare Advantage as well as the city council members' reactions to this attempt are discussed.
Earlier in March, a Manhattan Supreme Court judge ruled that the New York City cannot financially penalize the city retirees who decide to stay on traditional Medicare. The plan to monthly charge $191 to retirees who doesn’t switch to the Medicare Advantage was against the local law that, according to Justice Lyle Frank, required the city to “pay the entire cost of health insurance coverage for city employees, city retirees, and their dependents.” Pollock Cohen partner Steve Cohen represented the retirees in this case.
This time, Mayor Adams is trying to enforce the change to Medicare Advantage by changing the abovementioned law, Administrative Code 12-126. To counter this and protect the rights of senior citizens and disabled first responders, Steve Cohen has been actively working with Council members and senior staff.
